25-Year Guarantee Terms

    ClearPane Windows is proud to back every replacement sealed unit we install with a 25-year guarantee. These terms set out exactly what the guarantee covers, what is excluded, and how to make a claim. They form part of our overall Terms & Conditions.

    1. Who provides the guarantee

    1. This is a non-insurance backed guarantee, self-funded by ClearPane Windows ("we", "us", "our", the "Guarantor").
    2. The guarantee is offered to the named customer on the invoice ("you", "your") and applies to both consumers and business end users.

    2. What is covered

    1. The guarantee covers replacement glass double glazed sealed units ("Units") supplied and installed by ClearPane Windows within the United Kingdom.
    2. Subject to these terms, if a Unit develops a manufacturing defect causing seal failure, misting or internal condensation within 25 years of installation, we will, at our sole discretion:
      • repair the Unit free of charge; or
      • replace the Unit (including installation) free of charge; or
      • refund the original amount paid for that Unit.
    3. The defect must be notified to us in writing within the 25-year period.

    3. What is not covered

    The guarantee covers the glass element of a Unit only. It does not cover:

    • Hardware supplied with or attached to a Unit, including handles, locks, hinges, fixings and gaskets.
    • Damage caused by natural disasters, subsidence or movement of the building.
    • Theft of, or vandalism or criminal damage to, a Unit.
    • Any occurrence of thermal stress.
    • Accidental damage and impact damage.
    • Fair wear and tear.
    • Damage caused or made worse by misuse, neglect, or failure to maintain the Unit in line with the care guidance provided at the time of installation.
    • Minor cosmetic issues such as fading of colour or minor imperfections within Glass and Glazing Federation tolerances.
    • Cracks in the glass, unless reported within 4 weeks of fitting.
    • Damage to surrounding frames, beadings, sealants or paintwork.

    4. Carrying out repairs

    1. All replacement and repair work shall be carried out by ClearPane Windows or a contractor we nominate.
    2. You must provide reasonable access to the property at a reasonable time so that the repair or replacement can be carried out.
    3. We will use reasonable efforts to match any replacement Unit as closely as possible to the original. An exact match may not always be possible - for example where a Unit is no longer manufactured or is not commercially available on reasonable terms. We reserve the right to use new or refurbished replacement units at our sole discretion.
    4. Glass used in Units may have minor imperfections. We are not obliged to replace or repair glass that would not be covered by the original glass manufacturer's warranty. In the event of a dispute, the standards of blemish acceptability laid down by the Glass and Glazing Federation will apply.

    5. Personal to you and non-transferable

    1. This guarantee is personal to the customer named on the invoice and is not transferable to any other person.
    2. The guarantee will automatically terminate if you sell, sublet, assign, part with possession or otherwise transfer ownership or occupancy of the property in which the Unit is installed, or upon your death.
    3. No rights under this guarantee may be assigned or transferred to any third party.

    6. Your statutory rights

    You have statutory rights as a consumer under the Consumer Rights Act 2015 in relation to goods and services we supply. This guarantee is offered in addition to, and does not affect, those statutory rights.

    7. How to make a claim

    1. Email admin@clearpanewindows.co.uk with your name, address, invoice number and date of installation.
    2. Include clear photographs of the affected Unit showing the defect.
    3. We will acknowledge your claim within 5 working days and arrange an inspection at a mutually convenient time.
    4. A claim can only be processed once we have received a copy of the original invoice and your completed claim details.

    8. Limitation of liability

    Our total liability under this guarantee is limited to the repair, replacement or refund of the affected Unit as set out above. We are not liable for indirect or consequential losses, including loss of profit, business or opportunity. Nothing in this guarantee limits our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.

    9. Governing law

    This guarantee is governed by the laws of England and Wales. Any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
